Transmissibility of the moral damage of the deceased worker to his heirs
498/5000 In December 2016 the Supreme Court ordered a company to pay $ 100 million to the wife and children of a deceased worker in the context of an occupational accident. The ruling sets a precedent for Chilean jurisprudence which, until now, mostly held that the moral damage suffered by a deceased worker was intransmissible. This scenario opens the way for other heirs to sue the employers for moral reparation for the loss of their relatives.
